MINUTES OF THE PARISH COUNCIL MEETING HELD ON WEDNESDAY 1st AUGUST 2018 AT 7.30 p.m. IN THE VILLAGE HALL, WESTON IN GORDANO

PRESENT:    Cllrs. J Bennett, D Giles, M Squire and P Yates-Round

1. APOLOGIES FOR ABSENCE:  Cllrs Mrs S Chambers, D Down and P Harris also PCSO Hayley Hembery.

 

2. MINUTES OF THE LAST MEETING: The minutes of 5th July Meeting were agreed and signed off by Cllr Yates-Round.

 

3. MATTERS ARISING FROM THE PREVIOUS MINUTES AND ACTIONS:

See individual items.

 

4. FINANCE:

Bank balance:  £11,681.14

Balance at this time last year £10,519.08

Clerk’s monthly expenses: £1.00

Invoices:  SSE - electricity for Cadbury Lane lamp and phone box-                        £11.29

                 Cllr J Bennett invoice for plants and compost for planters                     £140.34                                                                               

All agreed above payments and 2 cheques signed off by Councillors.

           

5. PLANNING: : 28/P/3554/FUH – Silver Birches, Clevedon Road – Erection of front porch.   This had been part of the list of planning applications not received by the clerk for three weeks and when she did receive it, the details were circulated to the councillors for their comments.  There were no comments and Clerk will advise planning officer accordingly.

 

6. HIGHWAYS/PUBLIC RIGHTS OF WAY: Parishioner had said he was concerned with the state of the pavements and road with loose gravel remaining following the road being resurfaced.  Councillors were concerned pedestrians could slip on the gravel and Clerk to email Rob Thompson about this and having the road/pavements cleaned.  Gravel could also remove carriageway markings.   There is also a damaged drain cover outside Churchfield Barn.

Chairman opened up the meeting and councillors were advised that Cadbury Lane had been repaired by ETM, following that company importing topsoil to the AMARC site.       

 

7. ROUTINE CORRESPONDENCE:

From North Somerset –– Register of Electors – Amendment – NOTED

- List of road works programme – including B3124, Clevedon Road – Valley Road to Clapton Lane. NOTED AND ON NOTICEBOARD.

8. SPEEDWATCH:  Police have now established that they can stand by Myrtle Cottage to conduct Speedwatch.  Nick Gough will send new sheet for 20mph speed limit to Cllr Squire for returns.  Police will be conducting the Speedwatch at both ends of the village.   Police catching 1 in 5 vehicles going through the village.  It is believed speed of vehicles has dropped.  Cllr Yates-Round had been asked if the parish council would like a VAS (vehicle activated sign) in the village.  Cllr Squire to arrange.     

 

9. GORDANO GREENWAY:  Survey still in process by North Somerset Council.

 

10.NEIGHBOURHOOD WATCH:  Noting to report. 

 

11. RURAL BROADBAND:  A parishioner has surveyed the village and marked up on a map where the broadband boxes will be, so that villagers can share if they wish.  There was concern about cables being overhead, but they will be underground.  Will roads needs to be closed to install?  Concern about block paviours being reinstated.  It was suggested that Gigaclear be asked to speak at a parish council meeting about the broadband.

 

12. MIDDLE HILL COMMON BRIDLEWAY: Nothing has been heard from Avon Wildlife Trust or North Somerset Council about the Common.

 

13. VILLAGE GREEN:  Cllrs Bennett and Giles had again net with Mr and Mrs Morley.   The Morleys’ had four arguments for access across the Village Green.

Garage is 15 yards from highway.

Parish Council letters are legal documents.

Dropped kerb and hard standing (now removed) indicates access.

Garage has been on site since 1956, before the village green was registered as such.

Cllr Giles suggested Parish Council ask for a written letter from Mr and Mrs Morley’s lawyer.

It is understood that Mr and Mrs Morley do not have any permission to access the garage in their house deeds.

Dropped kerb could be for mower to access village green.

It is believed the lawyer advising Mr and Mrs Morley is from a union which Mr Morley belongs to.

There was discussion on the history of the village green and Councillors believe the Morleys did not have a search on the property at the purchase date, when the access problem would have been raised.

Garage has not been used continually for storing a car.

Until the last two years, nothing has been received from the Morleys about crossing the village green.

Mr and Mrs Morley are happy to observe any restrictions imposed by the parish council.

Suggestion that if easement is arranged, there should be restrictions on use on certain dates and responsibility for repairing any damage to the green.

Would the Morleys be prepared to pay the legal costs involved?  Parish Council could revise the easement in, say, 5 years’ time.  Concern about what happens in future when there are new owners in Honeysuckle Cottage.

13. VILLAGE GREEN:  (continued)

Councillors unsure if the Morleys’ claim is valid. Do they have legal claim over the access to the garage across the village green?  Chairman said the parish council had done a lot to help the Morleys, including supporting their application to provide parking at the front of their property.

Mr and Mrs Morley’s requests are: 1. Property does indicate access across the village green.  Response – nothing in the deeds.

2.   Letter from parish council dated 30th November 1996 – last paragraph says “It should of course be noted that this is the view of the present Council and cannot be taken as a commitment for future Councils.”

Further discussion on whether the village green was being used as access to the garage before being given village green status.  

It is believed there are strict restrictions on village greens now.

Following further discussion, Councillors asked Clerk to write to Mr and Mrs Morley asking for their lawyer to put any requests in writing to the parish council in order for this matter to progress.  Clerk to circulate suggested letter.          

 

14. ANY OTHER BUSINESS:  Councillor asked about a bench for the village green.  Cllr Bennett is looking into this.
